The Bateman Horne Center (“BHC”) understands how important the privacy of Personal Data is to our users. This Privacy Policy will tell you what information we collect about you and about your use of the BHC website found at (“BHC Site”) or any other mobile or web services owned, controlled, or offered and provided by BHC (collectively, the “BHC Service”).

We have prepared this Privacy Policy to describe to you our practices regarding the Personal Data we collect from users of BHC Service. If you choose to register with BHC, update an existing member profile, sign up for our newsletter, respond to a survey or marketing communication, surf the website, use certain other site features or access certain functionality of BHC Service, you may be required to submit Personal Data. “Personal Data” includes data that allows someone to identify or contact you, including, for example, your name, address, telephone number, e-mail address, date of birth, and device identifier as well as any other non-public information about you that is associated with or linked to any of the foregoing data. In addition, our interactive tools and services may require you to submit protected health information (PHI), which would also be considered Personal Data. It is always your choice whether or not to provide us with such information.  However, if you choose not to provide the requested information you may not be able to participate in BHC or access certain features or functions of BHC Service.

“Anonymous Data” means data that is not associated with or linked to your Personal Data; Anonymous Data does not, by itself, permit the identification of individual persons. We collect Personal Data and Anonymous Data as described below. You are responsible for ensuring the accuracy of the Personal Data that you submit to BHC. Inaccurate information will affect your experience when using BHC Service.

This Policy is part of BHC’s Terms of Service located at www.batemanHorneCenter/terms and all terms and conditions set forth in the Terms of Service apply with equal force in this Privacy Policy. We urge you to read this Privacy Policy carefully.


By signing the required informed consent form provided at the time of registration and using BHC Service, you accept and hereby expressly consent to the terms of this Privacy Policy. This Privacy Policy may change from time to time, so please check back periodically to check the most recent modification date to ensure that you are aware of any changes. Your continued use of BHC Service after any such changes signifies your express consent to such changes.   If you do not agree to such changes, you must immediately stop using BHC Service.

If you do not want your Personal Data used by BHC as provided in the informed consent form and this Privacy Policy, you should not register as a member of BHC or for any specific tool or application that collects Personal Data.

You may correct, update or review Personal Data you have submitted through registration by [signing in] and updating your [registration information]. If, at any time, you wish to withdraw all or some of your Personal Data and request that your remaining sample be destroyed, you may send a written request to:

Neither BHC nor any of its Services are designed for, intended to attract, or directed toward children under the age of 13. A parent or guardian, however, may collect a sample from, create an account for, and provide information related to, his or her child. The parent or guardian assumes full responsibility for ensuring that the information that he/she provides to BHC about his or her child is kept secure and that the information submitted is accurate. If we become aware that a person under 13 has provided Personal Data without consent from a parent/guardian, BHC will take steps to remove such information and terminate that individual’s account, access and use of BHC Service. Given that the Internet operates in a global environment and that transfer of your Personal Data is necessary to process your registration and use BHC Service, to provide updates, and to respond to your inquiries, using the Internet to collect and process Personal Data necessarily involves the transmission of data on an international, or cross-border, basis.  By registering for or using BHC Service, and/or by communicating with us via our website or by email, you acknowledge and expressly consent to our processing and disclosure of your Personal Data in this way. The Personal Data of users who are located outside the U.S. will be transferred outside of each eligible country to the United States where our servers are located and where it will be processed and stored on servers in the U.S. We will take all steps reasonably necessary to ensure that users’ Personal Data is treated securely with respect to such transfer, but will not otherwise take steps to ensure compliance with applicable laws in each user’s country of residence.



Whenever you visit the BHC Site, or access BHC Services, we receive and record information on our server logs from your browser, including your IP address, BHC’s cookie information, and the pages you request, and relate it to the Personal Data you provide.

BHC collects and uses information you provide to:

  1. Provide, analyze and improve BHC products and services to you;
  2. communicate with you about our products and services or to reply to your request for information or comments;
  3. with your consent, provide information to you about developments, announcements, promotions or new products or services;
  4. conduct research, the results of which could be used to develop therapeutics;
  5. if applicable, provide information to and receive information from third party vendor(s) for purposes of provisioning and arranging shipment of your supplies (e.g. blood sample kits);
  6. with your consent, provide information to your health plan provider related to BHC programs;
  7. provide de-identified reporting (i.e. reporting that does not contain any PHI) for internal and external clients and associated partners.

Cookies. Our Site uses a software technology called "cookies." Cookies are small text files that we place in visitors' computer browsers to store their preferences. Cookies themselves do not contain any Personal Data.

Profile. We may collect Personal Data from you, such as your name, address, ethnicity, age, gender, date of birth, email address, and password for BHC Services, and any other information you voluntarily add to your profile on the BHC Site, app or information that is generated by your use of BHC Service (“Profile Information”).

Account Information. We may require you to provide an email address and password to use all features of BHC Services (“Account Information”).  You may change the email address and password associated with the account according to the methods provided by BHC Services.

Feedback/Support. If you provide us feedback or contact us via e-mail, we will collect your name and e-mail address, as well as any other content included in the e-mail, in order to send you a reply. If you contact us for support, we may also collect and retain certain technical diagnostic data, e.g., the make and model of your phone.

Mailing List. If you provide us your email address for inclusion in our mailing lists, we will collect your email address. We may email you news about BHC, BHC Service updates, and third party offers that apply to you. You will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the e-mails you receive.

Other. We may also collect Personal Data at other points in BHC Service that state that Personal Data is being collected.  BHC will retain Profile Information on the servers for BHC Service for as long as needed to provide BHC Service and to comply with our legal obligations, resolve disputes and enforce our agreements.


By agreeing to our Privacy Statement and Terms and completing the Informed Consent Form provided at the time of registration, you consent to sensitive information, including, but not limited to information you provide us about your physical or mental health, genetic information, racial and ethnic origin, age and sexual orientation (where you provide it) (“Sensitive Information”) being used by us to:

  1. analyze and provide you with our Services;
  2. determine whether you would be suitable to take part in surveys, polls, questionnaires or research studies that we are conducting; and
  3. monitor and improve existing products or services that we offer or develop new products and services

We will not use your Sensitive Information without your consent unless: (i) the information has been anonymized or aggregated so that you cannot reasonably be identified as an individual; or (ii) a legal obligation requires us to use it in some way e.g. a court order requires us to disclose the information.


BHC does not rent, sell, or share your Personal Data with other individuals or nonaffiliated companies for purposes not related to BHC Services provided except to share, disclose or transfer your Personal Data when we have your consent to share such information, when we provide Personal Data to third parties working on our behalf to provide Services that you request (as more fully described below), or to third parties under confidentiality agreements with us.

We use your Personal Data in the following ways and as described elsewhere in this Privacy Policy: (a) to identify you as a user on BHC Service; (b) to improve BHC Service; (c) to provide the services you request, including BHC Service; (d) to respond to your inquiries related to support, or other requests.

Third Party Service Providers. We may share your Personal Data with third party service providers to: provide you with BHC Services; to conduct quality assurance testing; to provide technical support; and/or to provide other services to BHC.  Except as otherwise stated in this Privacy Policy, these third party service providers are required by contract not to use your Personal Data other than to provide the services requested by BHC.

Third Party Websites and Tracking. BHC Service may contain links to third party websites.  The fact that BHC has provided a link to a website is not an endorsement, authorization, sponsorship or acknowledgment of affiliation with respect to such website, or with respect to any products, services, information or content on such website.  When you click on a link to any other website or location, you will leave the BHC Site and go to another site and another entity may collect Personal Data or Anonymous Data from you. We have no control over, do not review, and cannot be responsible for, these outside websites or their content. Please be aware that the terms of this Privacy Policy do not apply to these outside websites or content, or to any collection of data after you click on links to such outside websites. Not all third-websites allow you to opt out of their tracking and analytics.  We cannot advise on whether your selection of "Do Not Track" option will have any effect on the collection of cookie information by the third parties who collect such cookie information on our site.

Other Disclosures. Regardless of any choices you make regarding your Personal Data (as described below), BHC may disclose Personal Data in response to subpoenas, warrants, or court orders, or in connection with any legal process, or to comply with relevant laws; to establish or exercise our rights to defend against legal claims; if we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, safety of person or property, violation of our policies, or as otherwise required by law.

Your Choices Regarding Your Personal Data; Changing Your Personal Data.

Changes to your Personal Data. You may change certain fields of your Profile Information by editing your profile on the BHC Site. You may request deletion of your Personal Data by us, but please note that we may be legally required to keep this information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete any information, it will be deleted from the active database, but may remain in our archives. We may keep your Personal Data and your usage history for administrative purposes.

Security of Your Personal Data. BHC is committed to protecting the security of your Personal Data from unauthorized access, use, or disclosure. We use a variety of industry-standard security technologies and procedures to help protect your Personal Data from unauthorized access, use, or disclosure. However, no method of transmission over the Internet, or method of electronic storage, is 100 percent secure. Therefore, while BHC uses reasonable efforts to protect your Personal Data from unauthorized access, use, or disclosure, BHC cannot guarantee its absolute security.

Access to your Personal Data.  You may access, review, change, update or delete to your Personal Data and request information about our collection, use and disclosure of such information by contacting us at [email protected] or 801.359.7400. You may also withdraw your consent by emailing us to do so, to the extent permitted by applicable law. If you wish to unsubscribe from any of our emails, please click on the “unsubscribe” feature on the email you receive from us.

Recruiting for external research. Academic institutions, healthcare organizations, and other groups are always conducting interesting new research projects. We want to make you aware of these opportunities. While we do not share Personal Data with third parties without your consent, from time to time we may inform you of third-party research opportunities for which you may be eligible. For example, if a university tells us about a new research project, we may send an email to BHC members who potentially fit the relevant eligibility criteria based on the self-reported Personal Data to make them aware of the research project and provide a link to participate with the research organization conducting the study. If you do not wish to receive these alerts, you can manage your settings so you do not receive such communications.

Opt-Out Options. You may opt-out of receiving future messages and announcements from BHC and remove your name from our mailing lists. The opt-out provisions do not apply to information collected by cookies or used internally to recognize you and/or facilitate your visits to BHC Site, or information we may retain to comply with legal requirements.

Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Utah, without giving effect to any principles of conflicts of law.

Jurisdiction. Except as set forth in the Terms and Conditions, you agree that any action at law or in equity arising out of or relating to this Agreement or the Service shall be filed only in the state or federal courts in the State of Utah and you hereby consent and submit exclusively to the personal jurisdiction of such courts for the purposes of litigating any such action. Nothing in this Agreement shall prevent BHC from seeking injunctive relief in a court of competent jurisdiction.

Changes to This Privacy Policy. We can change, modify, add, or remove portions of this Agreement at any time by sending an e-mail to the last e-mail address you provided to us (if any) and/or by prominently posting notice of the changes on the BHC website or Service. Please check this Agreement periodically for changes. You are responsible for providing your most current e-mail address. If the last e-mail address you provided us is not valid, or is not able to deliver to you the notice described above, sending the e-mail is still effective notice. If you continue to use the BHC Site or Service after we send you an e-mail notice or post modifications or changes on BHC Site or Service, this constitutes your binding acceptance of the changes. For any material changes to this Agreement, you acknowledge and agree that those amended or modified terms are automatically effective thirty (30) days after we send you an e-mail notice or thirty (30) days after they are first posted on BHC Site or BHC Service. These changes will be effective immediately for new Users of BHC Site or BHC Service.
